Terms of Service

1. Acceptance of Terms

Welcome to drilx ("Service"), operated by drilx, Inc. ("Company," "we," "us," or "our"). By accessing or using our website at drilx.app, mobile application, or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are under 18 years of age, you must have the consent of a parent or legal guardian to use this Service. By using the Service, you represent that you have obtained such consent.

2. Description of Service

drilx is an AI-powered basketball coaching platform that provides video analysis and training feedback. The Service includes:

• Video upload and processing (up to 15 seconds, max 50MB)
• AI-powered basketball form and technique analysis using computer vision
• Personalized coaching feedback and scoring
• Custom drill and training recommendations
• Role model comparison analysis (paid tiers)

3. Eligibility and Age Requirements

You must be at least 13 years of age to use drilx. In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under the age of 13. If we discover that a child under 13 has created an account, we will promptly delete their account and all associated data.

Users between 13 and 17 years of age must have verifiable parental or legal guardian consent to use the Service. By allowing a minor to use drilx, the parent or guardian agrees to these Terms on behalf of the minor and accepts responsibility for the minor's use of the Service.

4. Account Registration

To access certain features of the Service, you must create an account using Google OAuth authentication via Supabase Auth. By creating an account, you agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

5. Subscriptions and Billing

drilx offers the following subscription tiers, processed through Polar:

Paid subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access until that date.

Prices are in US Dollars (USD) and may be subject to change. We will notify you of any price changes at least 30 days before they take effect.

6. Credits and Refund Policy

Analysis credits are consumed at a rate of one (1) credit per video analysis. Credits included in subscription plans reset monthly on your billing date. Unused credits from subscription plans do not roll over to the next billing period.

One-time credit packs are also available for purchase: Starter (3 credits, $1.99), Standard (10 credits, $5.99), and Bulk (25 credits, $12.99). Credits purchased via credit packs do not expire.

Refunds may be requested within 7 days of a subscription payment. Refund requests can be made by contacting support@drilx.app. Credit pack purchases are non-refundable once any credits from the pack have been used.

7. User Content

By uploading videos or other content to drilx, you grant us a limited, non-exclusive, royalty-free license to use, process, and analyze your content solely for the purpose of providing the Service to you. We do not claim ownership of your content.

You represent that you have all necessary rights to upload the content and that your content does not violate any third party's rights. You are solely responsible for the content you upload.

8. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Abuse, harass, threaten, or intimidate other users
• Impersonate any person or entity
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Upload malicious code, viruses, or harmful content
• Use the Service to develop competing products or services
• Upload content that is obscene, violent, or depicts illegal activities

9. Intellectual Property

The Service, including all software, algorithms, AI models, designs, text, graphics, logos, and trademarks, is owned by drilx, Inc. and protected by United States and international intellectual property laws.

The drilx name, logo, and all related marks are trademarks of drilx, Inc. You may not use our trademarks without prior written consent.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRILX, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless drilx, Inc. and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time through your account settings or by contacting support. Upon account deletion, all your personal data and analysis results will be permanently removed.

Sections regarding Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive termination of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
